Terms and Conditions
PhotoTOUR Travel Agency undertakes to provide, within its photo tours, high-quality photographic and/or tourism services to participants, hereinafter referred to as beneficiaries. All services provided are subject to the provisions set out below and in the service agreement that will be concluded between the provider and the beneficiary.
Acceptance of these conditions is implicitly made by the Beneficiary upon completion of the registration form and payment of the 50% advance.
Participant registration:
After completing the form you will receive an e-mail confirming that you are registered in our records. As soon as possible we will send you a payment link through the SmartBill payment processor. The link will direct you to the electronic invoice and for its payment you have two options:
payment by card, through the card processor approved by the SmartBill platform, which will process and issue the payment documents,
payment by bank transfer, the processing and payment documents will be issued by the provider, PhotoTOUR Agency, through the SmartBill platform.
Registration is considered valid only once the 50% advance payment or the deposit established for the respective tour has been paid.
Cancellation/rescheduling of participation:
Cancellation of participation in one of our tours can only be made in writing at: contact@phototour.ro; the following amounts will be retained to cover organizational expenses:
For domestic tours and “Experiences in Roumania, other than 1 day tour
between 60 and 45 days before the start of the photo tour, 10% of the total value will be retained.
between 45 and 31 days before the start of the photo tour, 50% of the total value will be retained.
between 30 and 14 days before the start of the photo tour, 70% of the total value will be retained.
less than 14 days before departure or in the event that the participant does not attend the photo tour, 100% of the total value will be retained.
Participants who cancelled their registration may reschedule for a future PhotoTOUR, subject to availability, however the retained amount (10%, 50%, 70% or 100%) covering common expenses will not be refunded.
For tours in the “Experiences in Romania” section:
For one-day tours, cancellations can be made free of charge between 30 and 7 days before the start of the tour.
For one-day tours, cancellations made between 7 and 2 days before the start of the tour are subject to a 5% cancellation fee.
For one-day tours, cancellations made between 2 and 1 days before the start of the tour are subject to a 50% cancellation fee.
For one-day tours, cancellations made less than 24 hours before the start of the tour are subject to a 100% cancellation fee.
For international tours:
Participant registration for international tours is done in the same manner as above, however cancellation conditions differ:
between 90 and 70 days before the start of the photo tour, the initial deposit for the tour will be retained to cover common expenses.
between 69 and 45 days before the start of the photo tour, 50% of the total value will be retained.
less than 45 days before departure or in the event that the participant does not attend the photo tour, 100% of the total value will be retained.
These are the general cancellation conditions for participation in our tours. For specific cases, cancellation conditions are presented for each individual tour.
Payment for international tours
The price of international tours is displayed in the currency accepted on the foreign exchange market of the region where the photographic tour takes place. Payment by bank transfer can be made in lei, euro or US dollars. If the payment currency differs from the currency in which the photo tour cost is expressed, a foreign exchange risk commission amounting to 3% of the payment value will be charged.
Health conditions:
By completing the registration form and paying the advance/deposit, participants certify that they do not suffer from mental illness or other disabilities that could create a risk for themselves or other participants. We reserve the right to request a medical certificate proving good health.
Once registration has been completed, medical circumstances will be considered exceptions to the cancellation policy only if a relevant medical certificate proving the impossibility to participate is provided. In this case we reserve the right, depending on the cancellation date, to refund a certain amount of the expedition cost.
As photographic tours involve travel in mountainous areas or regions with specific climates, signing the liability declarations specified below is mandatory.
Insurance:
Medical and accident insurance is mandatory for all participants in the tour/expedition. After registration, all participants will receive additional information regarding the risks that must be covered by insurance.
We also strongly recommend purchasing cancellation insurance immediately after registering for the tour, based on the documents issued by the Agency, to cover any possible withdrawal from participation for personal/medical reasons.
General terms and conditions:
Rights and obligations of the Agency
If the Agency is forced to modify one of the essential provisions of the contract, it is obliged to inform the tourist at least 15 days before the departure date. The occurrence less than 15 days before departure of unforeseen situations not caused by the Agency, such as: hotel changes without lowering the category, airline changes or flight schedule modifications, obliges the Agency to inform the tourist immediately upon becoming aware of the change. Such situations are not considered modifications of the essential provisions of the contract and do not constitute grounds for withdrawal.
The Agency may modify the contract price upwards or downwards only if the modification results from variations in transport costs, royalties and taxes related to landing/departure/boarding services in ports and airports, tourist taxes or exchange rates related to the contracted tourist services package.
In the event of hotel overbooking caused by hotel operators, before or after the beginning of the trip, the Agency will offer accommodation in the same or nearby area, of the same or superior category, without modifying the price.
If, after the tourist trip has begun, a significant part of the tourist services provided in the contract is not performed or the organizing travel agency determines that it cannot perform them, the Agency is obliged to offer the tourist suitable alternatives for continuing the tourist trip, without increasing the price, and the offered services must be of the same quality and quantity.
The Agency is responsible for the proper execution of the obligations assumed through the contract, except in the following cases:
a) when the failure or improper execution of contractual obligations is due to the tourist;
b) when the failure of obligations is due to force majeure or circumstances that neither the travel agency nor the service providers could foresee or avoid (schedule or itinerary changes, transport delays, strikes, natural causes preventing transport/accommodation etc.). Thus, in the organization of charter flights, the Agency is not responsible for damages caused to the tourist due to delays (including charter flights), lost luggage or other circumstances for which the air carrier bears sole responsibility.
The Agency is obliged to provide the tourist in writing, within 2 days before departure, with the following information:
a) schedules, stopover locations and connections, as well as, where applicable, the place to be occupied by the tourist in each means of transport included in the contract;
b) the name, headquarters/address, telephone and fax numbers of the organizer’s and/or retailer’s local representative or, in their absence, an emergency contact number enabling contact with the organizer and/or retailer;
c) for trips involving minors unaccompanied by parents, information allowing parents to establish direct contact with the child or the person responsible at the child’s accommodation location.
Optional excursions are carried out on site through local agencies. The amounts collected for these excursions are not collected in the name and on behalf of PhotoTOUR Agency. Prices for optional excursions may be higher than those purchased directly from hotel receptions because participants will benefit from transport to and from the hotel, the excursion guide and, where applicable, a local guide.
Rights and obligations of the tourist
If the tourist cannot participate in the tourist trip, they may transfer the contract to a third party who meets all the conditions applicable to the contracted tourist service package, provided that the Agency is notified in writing at least 5 days before departure. In this case, the Agency terminates the contract with the transferring tourist and concludes a new contract with the new tourist. The tourist transferring the service package and the transferee are jointly responsible for payment of the trip price and any additional costs arising from this transfer.
If the prices established in the contract are increased by more than 15%, the tourist may terminate the contract and is entitled to reimbursement by the Agency of the amounts paid.
If the tourist terminates the contract within the allowed term without penalties or if the Agency cancels the tourist trip before departure, the tourist has the right:
a) to accept, at the same price, another tourist services package of equivalent or superior quality proposed by the Agency;
b) to accept a tourist services package of inferior quality proposed by the Agency, with immediate reimbursement of the price difference;
c) to receive immediate reimbursement of all amounts paid under the contract, if there are no penalties (except in cases of force majeure, where the Agency is exempt from liability and has no obligation to reimburse the value of excursions).
3.1. In all the above cases the tourist is entitled to request compensation from the Agency for failure to fulfill the provisions of the initial contract, except when:
a) the cancellation was due to failure to meet the minimum number of participants mentioned in the contract and the Agency informed the tourist in writing at least 15 calendar days before departure;
b) the cancellation was caused by force majeure (unforeseeable circumstances beyond the control of the party invoking them and whose consequences could not be avoided despite all efforts, excluding overbooking);
c) the cancellation occurred due to the tourist’s fault.
The tourist has the right to terminate the contract at any time, in whole or in part, and if the termination is attributable to the tourist, they are obliged to compensate the Agency for the damage caused, including in cases of illness, family events or other situations not considered force majeure. If the tourist requests changing the hotel, room structure or any services, this is equivalent to contract termination, with the application of legal penalties and the conclusion of a new contract.
The tourist is obliged to pay at the hotel reception the resort tax, sanitation tax and other local taxes, without claiming compensation or reimbursement from the Agency.
If additional formalities are required for the trip (e.g. travelling with minors, change of tourist’s name following marriage/divorce etc.), the tourist will fulfill all legal requirements.
If a single person contracts services for a larger number of tourists, the contract conditions automatically extend to the entire group for which the services have been paid.
Penalties and compensation
If an embassy refuses to grant an entry visa for the tourist services package, all fees paid by the Agency to direct providers, as well as the agency commission, will be retained.
If a tourist who entered the territory of the state where the tourist services package is provided refuses to return to Romania and the authorities of that country incur any expenses related to them, the tourist is obliged to bear all such expenses.
Penalties equivalent to the contract price also apply if the tourist does not arrive on time at the airport or departure location, cannot travel because documents are not in order, or is turned back at the border by border police.
The tourist must submit in writing the request for withdrawal from the tourist services package, with registration number, to the Agency where the services were purchased. Otherwise, the withdrawal request will not be taken into consideration.
The Agency will grant compensation depending on the proven degree of non-fulfillment of contractual obligations.
The contract documents, constituting annexes to it, are the following:
a) The PhotoTOUR program and supplementary information
b) Declaration on own responsibility regarding health condition
c) Declaration of assumption of risk and liability

The processing of personal data is carried out in accordance with Law no. 677/2001 regarding the protection of individuals with regard to the processing of personal data and the free movement of such data.
The personal data entered by the buyer will be used by the Seller only for the declared purpose of this website. The information in the order form is necessary in order to send order confirmations, deliver ordered products, announce ongoing promotions etc., and will never be provided to a third party.
The Seller guarantees the confidentiality of this information. Each user has the right to view only their own personal data entered by them.
